Will my immigration status affect my personal injury case?

No. Under Florida law, your immigration status does not affect your right to file a personal injury claim or recover compensation for your injuries. Florida courts generally do not allow a defendant or their insurance company to use your immigration status against you when deciding fault or awarding damages for medical bills, pain and suffering, or wages you've already lost. The one place it can occasionally come up is a claim for lost future earning capacity, where the defense may try to raise deportation risk — an experienced attorney knows how to keep that argument out of your case or limit its impact. How long does a personal injury case usually take?

There's no single timeline. A straightforward claim with clear liability and finished medical treatment can resolve in a few months; a serious injury case, or one that heads to trial, can take a year or more. The biggest factor is your own medical treatment — we typically wait until you've reached maximum medical improvement before pushing for a final settlement, since settling too early can leave real future costs unpaid. From there, negotiations with the insurer usually run weeks to a few months. If the insurance company won't offer a fair number and we have to file suit, the court schedule adds time. We'll give you a realistic estimate specific to your case after an initial review.

Do you help clients with property damage after a car accident?

Yes. What if I was partially at fault for the accident?

You may still be able to recover compensation. Florida follows a modified comparative negligence rule under Florida Statute § 768.81: as long as you're found 50% or less at fault, your damages are reduced by your percentage of fault rather than eliminated — a $100,000 award with 20% fault assigned to you becomes an $80,000 recovery. If you're found more than 50% at fault, Florida law bars you from recovering anything, which is exactly why insurance adjusters look for any reason to push your share of fault higher. Building the fault picture early — police report, photos, witness statements, available video — protects you from an inflated number.

Do I have a case if I did not go to the hospital immediately after the accident?

Possibly, yes — but don't wait longer to see a doctor. Under Florida's no-fault insurance law, you generally have 14 days from the crash to get initial medical care to qualify for Personal Injury Protection (PIP) benefits (Fla. Stat. § 627.736); miss that window and your insurer can deny PIP coverage for the accident entirely, even if your injuries are real.
